Ikigai Foundation Terms of Use
Welcome.
The Ikigai Foundation ("we" or "us" or "Foundation") is a non-profit organisation headquartered in Mahé, Seychelles. Our purpose is to empower and engage local volunteers worldwide to participate in cleanup events and collect rubbish data under a free licence or in the public domain, and to disseminate this data globally, free of charge.

To support this community, we provide the essential infrastructure and organisational framework to local volunteer groups. We strive to make and keep systems and data content available on the internet free of charge, in perpetuity.

We welcome you ("you" or the “volunteer”) as a contributor.
1. Our Services
The Ikigai Foundation is dedicated to encouraging the growth of volunteer cleanup groups and the hosting of collection data. We act solely as a hosting service provider, maintaining the infrastructure and organisational framework. This infrastructure includes specialised bespoke technological solutions that enable volunteers to deliver their services to their communities.

Because of our unique role, please be aware of the following:
a. You are responsible for your own actions: You are legally responsible for your events, data contributions, use of APIs, and general use of our services. You should exercise caution to avoid any actions that may result in civil or criminal liability under applicable laws. We cannot offer any protection, guarantee, immunity, or indemnification against the application of such laws.

3. Refraining from Certain Activities
The Ikigai Foundation thrives due to a vibrant community of volunteers. We encourage you to act in good faith, be civil and polite in interactions, and make contributions aligned with our mission. The following activities, whether legal or illegal, are prohibited:

Harassing and Abusing Others
  • Engaging in threats, stalking, spamming, vandalism, or harassment.
  • Transmitting chain mail, junk mail, or spam to other volunteers.
  • Posting or modifying content with the intent to harm others, including inducing self-harm or triggering epilepsy.
Violating the Privacy of Others
  • Infringing on the privacy rights of others.
  • Soliciting personally identifiable information for harassment, exploitation, or unauthorised commercial use.
Engaging in False Statements, Impersonation, or Fraud
  • Posting libelous or defamatory content.
  • Impersonating another user or individual.
  • Misrepresenting affiliations or using another person’s name deceptively.
  • Engaging in fraud.
Committing Infringement of Intellectual Property Rights
  • Infringing copyrights, trademarks, patents, or proprietary rights.
Misusing Our Services for Other Illegal Purposes
  • Posting or trafficking unlawful obscene material.
  • Using our services in a manner inconsistent with applicable law.
Engaging in Disruptive and Illegal Misuse of Facilities
  • Posting malicious code such as viruses, malware, or worms.
  • Placing an undue burden on APIs, networks, or servers.
  • Accessing or tampering with non-public areas without authorisation.
  • Testing vulnerabilities unless meeting specific conditions.
4. Password Security
You are responsible for safeguarding your password and other security credentials. Never disclose them to third parties.
5. Trademarks
All Ikigai Foundation trademarks belong to The Ikigai Foundation. Any use of our trade names, trademarks, service marks, logos, or domain names must comply with these Terms of Use.
6. Licensing of Content
All volunteers contributing data must grant broad permissions for redistribution and reuse:

    • Creative Commons Attribution-ShareAlike 4.0 International License
    • GNU Free Documentation License
  • Public domain content: Must be confirmed as public domain under relevant laws.
  • Reuse: Must comply with the underlying license(s), except where fair use applies.
7. DMCA Compliance
We respond to DMCA takedown notices and will terminate repeat infringers. Volunteers are encouraged to file counter-notifications if a takedown demand is believed to be invalid.
8. Third-Party Websites and Resources
We are not responsible for third-party websites, social media, or apps linked through our services. Use of such services is at your own risk.
9. Management of Technical Resources
You can notify us of illegal or policy-violating content. We may take appropriate action, including blocking accounts or banning users. Repeated violations may lead to a global ban.
10. API Terms
Our APIs must be used in accordance with our policies, including the User-Agent Policy, Robot Policy, and API:Etiquette.
11. Termination
We reserve the right to terminate your use of our services at any time. If terminated, your contributions will remain publicly accessible, but you may lose account access.
12. Disputes and Jurisdiction
Disputes must be resolved through our internal procedures. Legal claims must be filed exclusively in Victoria, Mahé, Seychelles, under Seychellois law. Claims must be filed within one year or be barred.
13. Disclaimers
Our services are provided "as is" and "as available" without warranties of any kind. We do not guarantee accuracy, security, or uninterrupted service. We are not liable for third-party content, data loss, or system damages.
14. Limitation of Liability
We will not be liable for indirect, incidental, special, consequential, or exemplary damages. Our total liability shall not exceed €1,000.
15. Modifications to These Terms of Use
Substantial changes to these Terms will be open for public comment for at least 30 days. Legal or administrative changes will have a minimum three-day notice period.
